FORMAL REQUEST - That HSX Correct The (SUPR2) Adjust Based Upon The 125.08 Opening. (INSIDE).

Adjusting the Market Calendar significantly after the Saturday Halt is highly improper. Prior to the Saturday Halt, the Market Calendar made no mention at all about 'PREVIOUS'. If HSX intended to treat the 12 MILLION as 'Previous', HSX should have Adjusted the Market Calendar to reflect the same, well in advance of the Saturday Halt. It did not do so.

This is an HSX matter, not an ERC matter nor an anybody else matter. HSX knew full well the entire circumstances of the 12 MILLION days in advance of the Saturday Halt, yet deliberately chose not to make any Adjustments to the Market Calendar. Any suggestion that the original Posted Market Calendar should not include the 12 MILLION at all for the Adjust has no merit as it is clearly part of the Opening. Further, had HSX intended for the 12 MILLION not to be part of the Opening, it certainly had the Authority to so advise and to Adjust the Market Calendar accordingly. It did not.

The fact that HSX deliberately chose not to Adjust the Market Calendar, deliberately chose not to advise that the 12 MILLION would not be included in the Opening, and deliberately chose not to advise that the 12 MILLION would be treated as 'Previous' leaves the inescapable conclusion that the HSX Market Calendar Rules as Posted considered the Opening to be 125.08.

HSX had every opportunity to so advise how it would treat the Opening of 125.08 at anything other than the 2.7 Multiple. The ability to act & advise was entirely within the Jurisdiction and Authority of HSX. The failure to do so is entirely the responsibility of HSX.

Any ambiguity or uncertainty in this matter is entirely at the Doorstep of HSX. HSX having created this ambiguity and uncertainty by its failure to so properly Advise, it is hereby Formally Requested that HSX Correct the (SUPR2) Adjust based upon the 125.08 Opening.
