The sites generate revenue from those hits which would have been reserved for the folks getting the "real" released trailer. Point is...the trailer is copyrighted and owned by the distributor for their release how they see fit for profit to those who are able to release it if indeed there can be profit. Unauthorised release of someone else's product is a trafficker of pirated goods. No, those sites won't be prosecuted because enforcement jsut wants to stop it. If the source is a repeat offender then I presume prosecution could follow. My understanding is enforcement wants the source. And while trailers or clips aren't "mortal sins" they do contribute to the mentality of pirating isn't so bad.
I suppose even the photos we see from on-set are a form of pirating but I haven't seen where that is as much an issue as clips or torrents.
To each his own. I can't watch 'em.
