My condolences for your loss.
As for the legal family issues, they can be fought (and IMHO should be) but the emotional cost may be more than you want to pay. I was in a similar if not quite as bad situation some years ago. If your lawyer says it can't be fought, fire him and get one who will. Just in what you posted there are at least two major problems with your sister's actions. I know its hard and I'm sorry but you will have to move quickly because she's going to do so, counting on your grief to keep you silent.
