often waited many decades (20+ years) in essentially solitary confinement on Death Row, with only the POSSIBILITY of actual death happening in most cases.
It was the type of confinement coupled with the recurring THREAT of death that was deemed in violation of the "cruel and unusual" part.
Basically, the judge was saying, "speed up the killings, or don't do it at all." He said the PROCESS that the California law for the death penalty created unnecessarily long waits and arbitrary delays, and that they should either rewrite it to specifically prescribe timelines and milestones to expedite the sentence of death, or scrap it altogether.
Makes sense, either way.
