While it was dismissed in this case, that's a reasonable argument to bring - venues have a responsibility to ensure they are safe, and if they don't meet that responsibility then they should be liable.
Also, these aren't people looking to make a quick buck, they are people with trauma and medical bills who need ongoing support and may not have a way to pay for it.
