IIRC the various rights to Superman are scattered among various parties.
For example, the CW show 'Smallville' legally could NOT show Welling in the suit or flying. I don't think they could even have his character called "Superman" (remember for several seasons he was "The Streak"?) So the people/studio producing 'Supergirl' probably didn't have rights to actually show Superman in their first season.
