from what I've read in the past
and don't make me search for it, all Weinstein originally needed to do is ask WB permission for it's use. They didn't, thus created a whirlwind of legal problems, numerous PR's which all equals to free publicity for the film. You know as well as I do that Weinstein's are notorious for stirring up controversy to get it.
