I think it's decided on a case-by-case basis.
My impression is that HSX waits until it looks like a movie has been dead for a while before they delist it. They have been known to be wrong; if I remember correctly, Basic Instinct 2 was delisted at one point, only to be re-IPO'd when it was actually made. I generally hold those long, because you never know when one of those is going to pop. I bought Benjamin Button at 66 cents.
