RotoHockey, you should re-examine the law and statutes.

Posted by: Trentacus on Dec 03, 08:23 in response to RazorHawk's post let me try to rephrase what HSXsanity was intending to...

Free Speech is a right, and you are free to speak your mind. However, you are limited as to the medians in which you distribute your speech. When you use a website, for example, HSX, you are (before being allowed to post) sign up and agree with the TOS. In it, it explicitly states what you are and are not allowed to do/say.

Furthermore, the Constitution and Bill of Rights protects those rights against governmental intrussion or other State intrussion without the course of due process, but in the case of speech, it is absolute. Companies and websites are free to limit this because you are not being forced to use their site as a means to display or otherwise broadcast your opinions or anything else you come up with.

The point being, when using a website such as this, you do not have any expectations of having the freedom to say whatever you want if you clearly violate the agreement YOU made with the host site prior to your statements. No matter what you, or anyone thinks. It's simple law and torts.

I hope I was able to enlighten you on Constitutional Law.

I've been busy on other projects lately, but there are two new articles on HSXsanity. RogerMore Nov 30, 14:08

thx {nm} tealfan Nov 30, 15:17

Au contraire. What you say on HSX is protected by the First Amendment. RotoHockeyYTD2012 Nov 30, 17:24

I am not bound, nor protected, by First Amendment. So, I guess those rules don't apply to me. Good thing there is a CoC... {nm} PVL Admin Nov 30, 19:11

Who said anything about losing First Amendment rights? Not me. RogerMore Nov 30, 19:50

Are you a constitutional lawyer (whatever that means)? I am a lawyer whose practice includes the First Amendment. I have concluded that DTXbro Dec 01, 12:09

Yeah, it's not a perfect article. I really wanted to get across that what's said on the boards is governed by the Terms of Use, and the 1st Roger More Dec 01, 14:28

Already did. {nm} RotoHockeyYTD2012 Dec 01, 17:21

I appreciate what you do here. If I believed it appropriate to pick those nits, I would have done it when I first read the article. {nm} DTXbro Dec 01, 19:13

let me try to rephrase what HSXsanity was intending to say... RazorHawk Dec 02, 12:14

Had HSXsanity said exactly that, there would not have been any problem. (See inside). RotoHockeyYTD2012 Dec 02, 15:57

I haven't observed a debate like this about the law since my first year of law school . . . DTXbro Dec 02, 18:48

You don't deserve a response from RogerMore. You {nm} eyescovered Dec 02, 19:10

You were the one who brought the First Amendment into the discussion. Antibody Dec 03, 17:10

Into this discussion? Not at all. Totally different matter and totally different issues. {nm} RotoHockeyYTD2012 Dec 03, 21:08

No, in the discussion of using the First Amendment as an excuse, {nm} Antibody Dec 04, 10:38

He already admitted that he was wrong - already made corrections. {nm} RotoHockeyYTD2012 Dec 03, 21:11

RotoHockey, you should re-examine the law and statutes. Trentacus Dec 03, 08:23

Enlightened - not at all - that's exactly what was being said. (See inside). RotoHockeyYTD2012 Dec 03, 16:49

Your statement, 'What you say on HSX isn't protected by the First Amendment' is patently FALSE. Please remove it. {nm} RotoHockeyYTD2012 Nov 30, 19:47

Still poorly worded - 'action by HSX under the First Amendment'. Please remove 'under the First Amendment'. (See inside). RotoHockeyYTD2012 Nov 30, 20:43

RogerMore explained the First Amendment perfectly, at 19:50, above. Saved me the trouble. Not sure what you're on about. {nm} edzep - Port Monkey! Nov 30, 20:47

Your statement 'The First Amendment applies ... not to private corporations' is patently FALSE. Please remove it. RotoHockeyYTD2012 Nov 30, 20:52

Yeah, I won't be making changes because you're not good at reading. RogerMore Dec 01, 07:00

Exceptional at reading. Small wonder they have to butter the sides of your head to get you through the Theatre Doors. RotoHockeyYTD2012 Dec 01, 12:10

You should start a blog and post there instead of here. Then you can delete all comments that contradict what you think/believe. {nm} eyescovered Dec 01, 12:25

Such name calling! I think I'm done giving you any attention. {nm} Roger More Dec 01, 14:26

Can we call you Butter Head from now on, Roger? Hmm..actually, that sounds more like a Bond girl name. {nm} Paul2k Dec 01, 15:52

Agent Butterhead - he likes he likes a good piece of toast --with butter melted not softened {nm} JDolphin Dec 01, 18:22

Licensed to spread. {nm} RogerMore Dec 02, 09:07

Licensed to fill. {nm} RotoHockeyYTD2012 Dec 02, 11:34

The First Amendment guarantees the RIGHT to say whatever you want. It does NOT guarantee the means. JohnTEQP Dec 02, 19:13

That's a good expansion on freedom of speech. edzep - Port Monkey! Dec 02, 20:40
