... and its trial scenes (the trials of Danton and Desmoulins) are heart-breaking, dreadful things; in BATM3 the trials seem to me to come across as a vague after-thought, and Commissioner Gordon's presence at one of them rather perfunctory.  If Nolan had decided to make something of a "trial of Gordon," attaching it to the movie's earlier concerns about Dent and the Dent Act, then I think it might have achieved something of the flavour of the trials in Mantel's novel.  Some more convincing narrative of a "suffering, imprisoned Gordon" might have helped the aimless feel of the second half of the film.

There are other things in the column/conversation I linked which I think are more resilient criticisms, but again, I think they don't interfere with the enjoyment of the movie in the way that the fate of Bane or the use / mis-use of Bane do.
