It's a no-brainer for Fox. Losing Daredevil is a small price to pay to keep Galactus and Silver Surfer.
They know that Disney/Marvel won't ever make R-rated movies, and seeing as Daredevil only really interconnects with Spider-Man and The Punisher, it won't really help Disney/Marvel all that much if the rights do revert back to them. But if Fox gives up the rights to Silver Surfer and Galactus, that would be a HUGE blow for their planned reboot of Fantastic Four, because it means that a huge enemy of F4 (and also a potential spin-off solo movie for Silver Surfer) goes down the tubes.
